Isabel’s chapter addresses the risks faced by directors, managers, advisors and other third parties who are involved in companies trading in the ‘twilight zone’ of insolvency.
Isabel says ‘It was an intensive process, especially in the context of the foreshadowed changes in the law as detailed in the Insolvency Law Reform Act 2016, which had just been released at the time of drafting the chapter. Given that the Treasury Laws Amendment Bill 2017 has recently been passed, which provides for significant reforms in the area of insolvency (including safe harbour provisions), the liability of directors for their conduct in the ‘twilight zone’ of a company, is as topical as ever.’
